食品卫生法调整的对象是食品卫生监督机构(下称食监机构)在监督管理活动中与食品生产经营当事人所发生的权利义务关系,它是由食品卫生法律关系的主体、内容和客体三要素构成。本文参考行政法律关系的一般理论,结合《食品卫生法》的有关规定和执法实践,分别阐述了三要素的内容。明确食品卫生法的调整对象,使各级食监机构在执法中有一个明确的界限,避免滥用、超越职权。
The object of the regulation of food hygiene law is the rights and obligations of the food hygiene supervision agencies (hereinafter referred to as the food safety supervision agencies) in the supervision and management activities with the parties involved in the food production and operation.
