本刊讯案例:2014年春节前,农民李某被某种业公司的番茄种子广告所吸引,第二天就将购种款汇到了某种业公司。同年4月下旬,李某家大棚里的番茄进入成熟期,可长成的果实与广告完全不符,里面多数是空的,且又酸又涩。事后,李某将某种业公司告上法庭。法院经审理认为,该种业公司以“产量高、市场畅销”等描述性语言发布虚假广告,欺骗和误导了原告,被告所销售的种子属假种子。经法院调解,某种业公司一次性给付李某赔偿金1.2万元。
