自2003年最高人民检察院、最高人民法院、公安部、司法部联合下发《关于开展社区矫正工作试点的通知》以来,社区矫正试点逐步向全国范围扩展,社区矫正执行主体逐步更换为司法行政机关,公安机关转而成为配合角色。应当说,随着社区矫正工作的顺利推行,必然要求实现社区矫正机构设置的制度化和规范化。但是,社区矫正机构设置问题至今未能解决,两高两部的《通知》并未明确社区矫正的机构设置。本文以此为题,试探讨我国社区矫正执行主体的构建及如何加强其执法力度与效果问题,以期对我国社区矫正工作的发展有所助益。

The Notice of the two high schools and two ministries did not specify the organizational structure of community correction. Based on this, this article tries to probe into the construction of the executive body of community corrections in China and how to strengthen the enforcement and effectiveness of law enforcement in order to help the development of community corrections in our country.
