10月22日下午,北京市东四环北路7号院内,一私人别墅的地下改建施工中发生墙体倒塌,事故造成施工人员6人死亡,3人受伤。施工方及物业相关负责人都被警方控制。一时大哗,这中间物业人要担怎样的责任呢?实际上,物业服务企业发现业主私搭乱建行为时,应及时与业主沟通,并进行劝阻,并依据《物业服务合同》、《业主公约》或者其他与业主签订的协议中有关约定事项,向业主出具书面停工告知函,同时留存好现场照片等相关证据;如业主不听劝阻,未停工并及时整改的,物业服务企业应及时向政府相关行政管理部门报告,并应积极配合政府行政管理部门处理业主私搭乱建违法行为。
