《上海市建筑面积计算规划管理暂行规定(送审稿)》明确,多、高层住宅的建筑层高不超过3.6米,商业、办公建筑层高不超过4.5米,层高超出上述规定的,按每2.8米为一层、余数进一的方法折算该层建筑面积,并按折算的建筑面积计人容积率。这是针对目前开发商利用层高规定的漏洞,对建筑空间进行插层利用并作为销售卖点,逃避建筑面积和容积率计算做出的规定。新规对地下室、阳台、飘窗等极有可能产生“偷面积”行为的房屋结构、部位的建筑面积计算方法、规则,
