证明评价是指法官就当事人提供的所有证据资料进行评价,以判断当事人对其主张事实的证明是否达到法官内心所把握的证明标准的一种活动。此种活动受到各种因素的影响。一方面,各项证明制度内部制约关系会对法官的证明评价活动产生影响;另一方面,证明制度外部的因素,包括诉讼目的、程序价值、审判权分享机制和法官管理体制等,也都会对法官的证明评价活动产生影响。这些影响虽然体现在实践层面,但是解决问题的落脚点,应当是制度优化。
