随着我国当前市场经济的发展,企业间的竞争日益激烈,作为竞争手段之一的知识产权保护工作也在加强。其中,商业秘密法律保护的完善也显得尤为重要。本文依据我国现行法律、法规和WTO《与贸易有关的知识产权协定》(简称Trips协定),简述了商业秘密的认定,以及我国目前对商业秘密的保护现状,从而结合实际提出了保护商业秘密的一点建议。
With the development of the current market economy in our country and the increasingly fierce competition among enterprises, the protection of intellectual property as one of the means of competition is also being strengthened. Among them, the improvement of legal protection of trade secrets is even more important. Based on China’s current laws and regulations and WTO Agreement on Trade-Related Aspects of Intellectual Property (abbreviated as “Trips Agreement”), this article briefly describes the recognition of trade secrets and the current protection of trade secrets in our country.
