工业化和经济发展引起环境犯罪是客观的必然,我国应将严格责任制度引入环境犯罪中。所谓严格责任,是指行为人实施了特定行为,而不问主观罪过或者主观罪过形式不明确仍然构成犯罪的刑法制度。将严格责任制度引入环境犯罪是完善我国环境刑法立法及司法实践之必要,有利于弥补过错责任之不足,有效地防止和制裁环境犯罪,体现刑法的功利与公正。
Environmental crimes caused by industrialization and economic development are objective and inevitable. Our country should introduce strict liability system into environmental crimes. The so-called strict liability, refers to the perpetrator of the implementation of a specific act, regardless of the subjective sin or the form of subjective guilt is not clear still constitute a criminal offense system. The introduction of strict liability system into environmental crime is necessary for perfecting the legislation and judicial practice of environmental criminal law in our country, which is conducive to making up for the deficiencies of fault liability, effectively preventing and sanctioning environmental crimes, and reflecting the utilitarian and fair criminal law.
