有这样一类职工,在单位里和正式工做着同样的工作,可是,涨工资、发奖金以及各种福利待遇,都没有他们的份儿,他们被称为“劳务派遣工”。在劳务派遣制度下,派遣单位与劳动者签订劳动合同,再与用工单位签订劳务派遣协议,将劳动者派遣至用工单位从事生产劳动的用工形式,其最大特点就是劳动力的雇佣和使用相分离,被派遣的劳动者不与用工单位签订劳动合同,而是与劳务派遣单位形成劳动关系,形成了“有关系没劳动,有劳动没关系”的特殊形式。劳务派遣形式还存在若干问题,可是,近几年来,劳务派遣人数却在迅速飙升,说其呈“泛滥”之 There are such workers who do the same work as the regular workers in their units.
