随着民主化进程的深入以及责任政府理念的普及,有关行政道歉的事例屡见不鲜。行政道歉即行政主体及其工作人员基于行政权的行使或者其他影响行政主体良好形象的违法或者不当行为而向社会公众或者特定行政相对人表达歉意的行政责任承担方式。作为行政责任的一种方式,行政道歉具有精神抚慰、恢复原有社会评价、救赎愧疚、争取理解、平息怨气、降低社会成本等功能。与国家道歉、司法道歉、刑事道歉、民事道歉详尽比较之后,发现行政道歉的五点特质:致歉主体恒定性、致歉对象多样性、致歉关系不平等性、致歉因素职责性和致歉过程互动性。
With the deepening of the democratization process and the popularization of the concept of responsible government, there are not many instances of administrative apologies. Administrative apology is the mode of administrative responsibility that the administrative body and its staff members apologize to the public or specific administrative counterparts based on the exercise of administrative power or other illegal or improper behaviors that affect the good image of the administrative body. As a way of administrative responsibility, the administrative apology has the functions of soothing, restoring the original social evaluation, salvation guilt, seeking understanding, quelling grievances and reducing social costs. After an exhaustive comparison with the national apologies, judicial apologies, criminal apologies and civil apologies, five characteristics of administrative apology were found: the constant apologies of the apologists, the diversity of the apologists, the unequal relations of the apologies, the responsibilities of the apologists and the process of apology.
