2008年10月,佳士得公司宣布将拍卖圆明园鼠兔首头像消息传出后,引发中国民众热议,近百人组成律师团追索。2009年2月24日,经过紧急审理,法国法院批准拍卖兽首。两天后,两尊兽首分别以1400万欧元高价被神秘买家通过电话竞拍购得。3月2日,中国收藏家蔡铭超召开新闻发布会宣布拍得铜像,但称因拍品无法入境而拒绝付款。至此,此次圆明园鼠兔首拍卖已成流拍事实。
