聘用制人员参与行政事务根源于社会事务的复杂多样性与政府资源有限性之间的矛盾。考察中国历代官吏制度和世界范围的实践,聘用制人员参与行政事务有其历史和现实依据。在当下中国,通过法律规制聘用制人员参与行政事务行为,需厘清行政机关与聘用制人员法律关系的性质,明确聘用制人员的法律责任。
The employment of hiring staff in administrative affairs stems from the contradiction between the complex diversity of social affairs and the limited government resources. In examining the system of the officials in all ages in China and the practice in the world, there are historical and realistic bases for employing personnel to participate in administrative affairs. In the present China, it is necessary to clarify the nature of the legal relationship between the administrative organs and the hiring staff and clarify the legal responsibilities of the hiring staff, by regulating the employment of personnel engaged in administrative affairs through the law.
