受贿罪是指国家工作人员利用职务上的便利,索取他人财物,或者非法收受他人财物,为他人谋取利益的行为。在受贿犯罪领域,国家工作人员与非国家工作人员勾结,收受贿赂的情况越来越多,共同犯罪的形式趋于多样化、复杂化。国家工作人员之间的共同受贿很容易认定,没什么分歧,在此不多讨论。本文拟对非国家工作人员构成受贿罪共犯问题进行探讨。
Bribery refers to the state staff to take advantage of their position to obtain other people’s property, or illegally accepting the property of others for the benefit of others. In the field of bribery crimes, collusion between state staff and non-state staff members has taken place in more and more cases of accepting bribes, and the form of joint crime tends to be diversified and complicated. Common bribery among national staff is easy to identify, with no disagreements and is not discussed here. This article intends to discuss the issue of non-state staff members constituting the crime of accepting bribes.
