食品安全权是公民获取无毒、无害、营养的食物,以保障身体健康和生命安全的一种权利。国际社会将食品安全权作为重要的人权予以立法保护。我国在立法领域尚未出现对食品安全权的直接立法。但公民能依据《食品安全法》、《侵权责任法》等对自身食品安全权进行维护。职能部门则能依据涉及食品安全权的法律法规对食品安全进行监管,以保障公民的食品安全权。
The right to food security is a right for citizens to obtain non-toxic, harmless and nutritious foods to protect their health and safety. The international community has enacted legislation to protect the right to food security as an important human right. Our country has not yet appeared in the field of legislation direct legislation on the right to food security. However, citizens can safeguard their own food safety rights according to the Food Safety Law and the Tort Liability Law. The functional departments can regulate the food safety according to the laws and regulations concerning the right to food safety so as to protect the citizens’ rights to food safety.
