在目前法律框架下,我国农村土地产权界定存在较多难点,一是农民集体产权界定的困境,它有可能导致农村集体经济组织或村委会的成员对农民利益的侵犯;二是农村集体所有制所有权行使界定的困境,当村集体经济组织或村委会代表集体行使所有权时,会出现代理的“缺位”和“越位”现象;三是土地承包经营权(土地的使用权)界定的困境,它会使人力资源和土地资源的流动偏离经济运行公平和效益的目标,导致人力资源和土地资源的浪费;四是土地处分权界定的困境,它会导致国家对土地用途的管制与市场经济发展之间的不协调、保证国家粮食安全与保障农民的收益权之间的不协调、经济布局与保障农民对土地使用权的不协调。
