作为区分法系重要标准的法律样式,是法律价值的重要组成部分。中国古代的法律样式随着历史的不断变迁,经历了从判例法过渡到成文法,进而发展为混合法的变迁。这不仅表现出法律样式的发展轨迹或者规律,也呈现出各法律样式(特别是混合法)的特点。本文试图从法律形式的角度,通过对中国各朝代法律形式的种类、内容以及数量等方面进行比较分析,以论证中国古代法律样式的确切表现形式。
As a legal standard that distinguishes legal systems, it is an important part of legal value. With the continuous change of history, the ancient Chinese legal style has undergone a transition from case law to written law and further to mixed law. This not only shows the development pattern or law of legal styles, but also shows the characteristics of various legal styles (especially the hybrid method). This article tries to demonstrate the exact manifestation of the ancient Chinese legal form through the comparative analysis of the types, contents and quantities of the legal forms of all dynasties in China from the perspective of legal form.
