仲裁(Arbitration),尤其是商事仲裁,作为一种争议解决方式,与诉讼、协商、调解等其他纠纷解决方式在一般层面上有相似之处,但是,仲裁更注重当事人的意思自治因素,而且仲裁具备强烈的民间性特征。海峡两岸的仲裁制度都已经施行了很长时间,随着社会的发展和进步,两岸的仲裁法律都有进一步提高和完善的空间。通过选取大陆与台湾地区仲裁法律制度中的典型规定包括仲裁协议、仲裁机构、仲裁程序以及裁决执行方面进行对比,试图总结出两岸之间以及与现行国际趋势间的不同点,以及未来仲裁法律制度进步的方向。
