藏族“赔命价”回潮是近来关注较多的问题。围绕该问题所产生的研究成果均遗漏了对个体行动者情感维度的分析。文章以科林斯的情感能量理论为依托,通过阐释情感能量驱动个体决策的运作机理,展现藏族传统“赔命价”仪式中产生的情感流和长期情感状态,认为在当前的刑事司法体制中,负载“自信”、“热情”、“成员归属感”等高端情感能量的符号性缺失是导致其功能不济与“赔命价”回潮的重要原因。相比之下,注重情感效能的刑事和解将是一个可欲的替代解决方案。
