为适应新形势的要求,第十届全国人大常委会将《中华人民共和国未成年人保护法》的修改列入立法计划。经过一年多的调研,全国人大内司委已8易其稿,8月22日,十届全国人大常委会第二十三次会议开幕,《未成年人保护法》修订草案首次提请全国人大常委会审议。保护未成年人的工作,应当遵循四大原则:一、优先保障未成年人的合法权益;二、尊重未成年人的人格尊严;三、适应未成年人身心发展的规律和特点;四、教育与保护相结合。未成年人的心理、生理健康问题很突出,尤其是青少年犯罪问题呈上升趋势,应当引起高度重视。据统计,2004年全国判决生效未成年犯罪人数比2003年增长19.05%,2005年1月至7月又比2004年同期上升23.96%,已经出现利用计算机网络诈骗、参与黑社会性质组织犯罪的新犯罪类型。据全国妇联有关负责人介绍,目前,我国一些流动家庭、单亲家庭、重组家庭中的家庭教育问题以及农村留守儿童问题日益突出。家庭教育、学校教育重智轻德、重知轻能的倾向还没有得到根本扭转。全社会关心未成年人健康成长的环境需要进一步优化,家庭、学校、社会“三位一体”的教育网络还需要完善。
