“有限的宪法典与宽容的宪政制度”所隐含的核心观念是宪法学的研究应该更关注制度的建构,只有宽容的制度才能为宪法典的发展提供必需的空间,从而更有利于实现宪法的精神和原则。本文以全球化所带来的权力关系和权利类型的变化,以及公民权利保障机制的世界性发展和当今中国权利保障的宪法外的发展为例,说明了宽容的宪政制度的重要性。宽容的宪政制度从抽象的文化视角上看,是指这一制度能够客观地看待、反映和容纳文化进化过程中文化冲突的普遍性,能够提供一种公共的政治空间,每一个个体不管文化观点如何,都能够在这一制度框架中寻求保护自己权利的方式。从具体的制度运行的机制的视角上看,则应该包括平等的利益表达机制、合理的利益协调机制和有效的权利救济机制。
The core concept implied in the “limited constitutional system and constitutional system of tolerance” is that the study of constitutional law should pay more attention to the construction of institutions.
