近年来,在处理一些船舶碰撞海事的过程中,在一些学者所发表的论文里,对什么是“互见”,什么是“能见度不良”,以及“在能见度不良的水域中近距离内发现来船究竟应执行什么样的规则”,提出了不同的看法。对此,笔者认为是由于《规则》条款未能对上述问题作出明确的规定与充分的解释而引起的。本文根据“海员通常做法”、海上避让的实践以及海事法庭的判案惯例,对“互见”与“能见度不良”应如何予以正确的定义,提出了看法,对有关条款的适用范围也作了进一步的探讨。同对,本文还就《规则》第3条第11款、12款及第二章“驾驶与航行规则”中的有关条款,提出了若干修改意见。
