“走出去”战略的深入实施,为我国企业走出国门,进行海外投资提供了明确的方向指引,越来越多的中国企业选择投资海外。但是,中国企业海外投资就是一把双刃剑,既带来了机遇,同时也带来了巨大的挑战。中国企业海外投资正处于起步发展的不成熟阶段,这就可能导致因无经验和底子薄面临更多的法律风险,特别是国别不同的法律风险。本文旨在通过对主要东道国的法律风险进行分析,找到造成风险的原因,并从政府和企业两个方面对可能遇到的法律风险进行规避。
In-depth implementation of the “Going Global” strategy has provided a clear direction for Chinese enterprises to go abroad and make overseas investments. More and more Chinese enterprises choose to invest overseas. However, overseas investment by Chinese enterprises is a double-edged sword, which not only brings opportunities but also poses great challenges. Chinese enterprises overseas investment is at an immature stage of initial development, which may lead to more legal risk due to inexperience and weaknesses, especially different country-specific legal risks. The purpose of this paper is to find out the causes of the risks by analyzing the legal risks of the main host countries and to avoid possible legal risks from both the government and the enterprises.
