土地流转制度近年来被提上议程,促使有关部门加强有关农村土地的规范性立法建设,创新符合适用于中国特色的土地流转机制,不断丰富和发展土地流转形式。完善我国土地产权的的排他性使用权、获取租金的收益权和资源的转让权,促使我国土地法的规范化,为其创造良好的法制环境和法律保障,切实保护人民的合法权益。本文着重分析现有农村土地流转市场所存在的关键性问题并提出相应的解决方案。
In recent years, land transfer system has been put on the agenda, prompting relevant departments to strengthen the construction of normative legislation on rural land, innovating in line with land transfer mechanism applicable to Chinese characteristics, and constantly enriching and developing land transfer forms. Improve the exclusive usufruct of land property in our country, obtain the right of rent and the transfer of resources, promote the standardization of our country’s land law, create a good legal environment and legal protection for it, and effectively protect the legitimate rights and interests of the people. This article focuses on the analysis of the existing rural land transfer market, the key issues and propose appropriate solutions.
