法律不是逻辑,但法律的运用离不开逻辑。逻辑推论的前提是法律规范、法学原理。但是我们必须注意细节问题,司法审判中的思维不能转移论题,或错误运用法律。判决理由与逻辑规则的运用是有区别的。在判决理由构建的过程中,法官思维不仅是根据法律的思维,更重要的是要根据与案件相对应的法律进行思维。这样才能得出合法性、合理性的判决。 Law is not logic, but the application of law can not be separated from logic. The premise of logical reasoning is legal norms, legal principles. However, we must pay attention to the details. The thinking in judicial adjudication can not divert the thesis or misuse the law. Judgment reasons and the use of logical rules are different. In building the judgment grounds, the judge’s thinking is not only based on the law, but more importantly, it is based on the law corresponding to the case.
