随着新的刑事诉讼法的出台,公检法机关积极发挥着刑事和解的作用。眼下正值该制度实践的初期,其中所反映出的问题日益凸显,原本的制度设计预期与实践之间存在着一些差距。然而,关于刑事和解的研究大多是集中于新刑诉法颁布之前的一种制度设计,制度确立之后的论述相对较少,在一定程度上影响了该制度的进一步运行发展。基于此,本文将阐明,在新刑诉法视域下的刑事和解制度的重要性,分析了其存在的不足,提出了相关的完善措施。
