律师在庭审实质化改革中的作用值得重视.以2018年《刑事诉讼法》修改后至今S省办理的132件案件为样本进行统计分析,结果显示,辩护律师在庭审实质化改革中发挥了重要作用,尤其在量刑辩护方面表现最为明显.同时也存在指定辩护律师辩护质量低、律师辩护在举证和质证活动中发挥的作用有限、无罪辩护与程序性辩护边缘化等问题.现阶段应优化律师辩护制度,增强量刑辩护质量,以提高律师辩护对庭审的影响;从长远来看,应完善立法,进一步推动以审判为中心的刑事诉讼法改革.
