公司自从诞生那天起,就是以营利为目的的组织形式。历史证明这是推动社会生产力发展的有效组织形式。但随着社会生产力的发展,公司的营利性也引发了一系列的社会问题,因此现代社会公司法应当在充分体现公司营利本质的同时,兼顾其他社会关系,为构建和谐社会服务,同时应当体现立法的前瞻性。
