经济犯罪中死刑的存置尚有一定的生命空间,但更不应忽视的是其生命空间的萎缩性与内部的不和谐性。死刑在经济犯罪中的存置经历了一个由广泛扩展再到适当限制的嬗变过程。其存置在价值层面尚有一定的合理性,但也孕育了不合理性的基因;传统刑法文化对实定刑法产生了根深蒂固的影响,重刑、泛刑、死刑以及宗法文化的发达与现代社会的法治刑法文化观念格格不入,发生着剧烈的碰撞与冲突。而传统文化的惯性对一国的经济犯罪中死刑的存废始终存在着幽灵般的或多或少的影响;无论是中国社会偏重伦理学角度的“性善”与“性恶”的人性之争,还是西方社会偏重法哲学角度的“理性”与“经验”的人性之争,都有难以克服的局限性。经济犯罪中不论是主张存置死刑抑或还是废除死刑,均有支撑其存在的人性基础。

In economic crimes, whether to advocate the death penalty or to abolish the death penalty, there is a human nature foundation that supports its existence.
