2001年欧盟颁布的《关于成员国法院间民商事取证合作第1206/2001号条例》协调统一了域外取证合作制度。条例规定的请求书取证制度与直接取证制度是取证合作方面的创举。《海牙取证公约》在两大法系国家间引发的冲突、《阿姆斯特丹条约》为欧盟在该领域直接立法奠定的基础催生了该条例。条例的实施与新近动态表明,欧盟在构建民商事取证合作机制上成效显著。其可为中国的相关立法提供借鉴。
In 2001, the EU promulgated the “Regulations on Forensic Cooperation in Civil and Commercial Matters between Member States, No. 1206/2001” to coordinate and unify the system of cooperation in extra-judicial forensics. The request for evidence collection system and direct evidence collection system stipulated in the regulations are the pioneering work of evidence collection and cooperation. The Conflict triggered by the Hague Convention on Forensic Evidence between the two legal systems states that the “Treaty of Amsterdam” laid the groundwork for the EU’s direct legislation in this area. The implementation of the regulations and recent developments show that the EU has achieved remarkable results in building the cooperation mechanism for evidence collection of civil and commercial affairs. It can provide reference for China’s relevant legislation.
