我国允许农民将住房转让给农村集体经济组织内符合宅基地分配条件的农户,但是禁止城镇居民在农村购置宅基地及其住宅。这种政策可以概括为严格限制宅基地使用权流转的政策。面对改革开放以来的城乡巨大变革,严格限制宅基地使用权流转的法律及政策已经不合适宜。这种政策不仅缺乏充分的法理依据,而且违反了市场经济规律。
In our country, peasants are allowed to transfer their houses to farmers in the rural collective economic organizations that meet the conditions for the distribution of house sites. However, urban residents are prohibited from purchasing homesteads and their dwellings in rural areas. This kind of policy can be summed up as a policy that strictly restricts the circulation of the right to use homesteads. Since the reform and opening up, urban and rural areas have undergone tremendous changes. The laws and policies that strictly restrict the circulation of the right to use homesteads have become inappropriate. This policy not only lacks adequate legal basis, but also violates the laws of the market economy.
