2013年12月31日,全國人大常委會公佈《中華人民共和國行政訴訟法修正案(草案)》,向社會公開徵集意見。現行行政訴訟法於1989年由七屆全國人大第二次會議通過,1990年10月1日起實施。這部被稱為「民告官」的法律規定了行政訴訟程序的基本規則,實施以來,在解決行政爭議、推進依法行政、保護合法權益等方面發揮了重要作用。同時,隨著社會主義民主法制建設的深入推進,行政訴訟制度與社會經濟發展不協調、不適應的問題也日漸突出。為解決這些問題,適應依法治國、依法執政、依法行政共同推進,法治國家、法治政府、法治社會一體建設的新要求,全國人大常委會法制工作委員會從2009年開始著手行政訴訟法
On December 31, 2013, the NPC Standing Committee promulgated the “Amendment to Administrative Procedure Law of the People’s Republic of China (Draft)” to solicit opinions from the public. The current Administrative Procedure Law was passed by the Second Session of the Seventh National People’s Congress in 1989 and came into force on October 1, 1990. This law, known as “civil prosecution,” stipulates the basic rules governing administrative proceedings.
