我国《劳动合同法》的出台是为了解决劳动合同短期化,更好地保护劳动者合法权益,但是该法中相关条款的设定不仅没有有效保护劳动者的合法权益,反而引发了大量企业的规避行为,导致劳动者与用人单位出现“双输”的局面。立法决策者在决策时必然需要获取新的信息,复杂化的劳动关系也导致相关信息的复杂化,这在一定程度上也给立法决策者带来了压力。第一,立法决策者对立法信息在客观上难以获取,加之其获取信息能力有限,带来了信息约束压力;第二,媒体信息进行选择性的传递以及在信息传递过程中的失真现象带来了媒体话语压力;第三,利益集团通过对立法决策者的影响,尤其是强势利益集团的出现也给立法决策者带来压力。由于各种压力的影响,导致博弈主体无法在平衡的力量下有效进行立法博弈,立法决策者在立法压力的影响下对决策进行了简单化处理,采取了权利倾斜性配置措施,这些都导致了不合理、有失公平的法律制度。为了解决上述问题,只有在对可能的立法方案进行成本收益分析的基础上,才能做出使社会效益最大化的选择;通过提高立法决策者获取信息的能力,可以让立法决策者获取足够有效的立法信息,制定出科学、合理以及有效率的法律制度。
