在广东省某地方的政府采购活动中,由于开标后第一候选人与第二候选人报价差额巨大,在公示期间第一候选人即宣布放弃。围绕第一候选人的民事责任承担,招标人与第一候选人存在分歧:招标人认为第一候选人应向其赔偿第一候选人与第二候选人的报价差额,而第一候选人认为仅以丧失投标保证金为代价即可。根据该地方的有关规定,评标结果必须经至少2个工作日的公示,增大了第一候选人放弃的风险,因此探讨第一候选人放弃的民事责任承担,具有理论与现实意义。
