本文从环境侵权责任赔偿中责任人所面临的“愿赔但无力赔”的问题入手,为完善民事侵权责任体系,提出构建环境侵权责任保险这一制度。通过进一步研究环境侵权责任保险制度的概念和特点,结合我国部分地区的试点经验,在分析我国构建环境侵权责任保险制度可行性的基础上,提出我国在构建环境侵权责任保险制度中应注意的问题。
This article starts with the problem of “willingness to pay but unable to pay” which the responsible person in compensation for environmental tort liability faces. In order to perfect the responsibility system of civil tort liability, this article puts forward the system of constructing environmental tort liability insurance. By further studying the conception and characteristics of liability system of environmental tort liability and combining with pilot experience in some regions of our country, based on the analysis of the feasibility of constructing insurance system of environmental tort liability in our country, this paper puts forward some problems that should be noticed in our country’s construction of environmental tort liability insurance system .
