各国法律制度的差异性和国际民事诉讼的特殊性决定了由不同国家法院行使案件管辖权,会对整个案件审理的各个环节及最终结果产生决定性的影响。管辖权的这种间接决定作用的产生、存在及其过度膨胀都是有其深刻的历史和现实原因的,这种间接决定作用的存在使得国际私法离它所追求的目标愈发遥远了。
The differences of legal systems and the particularity of international civil litigation determine that the exercise of jurisdiction by courts in different countries will have a decisive influence on all aspects of the entire trial and the final result. The emergence, existence and over-expansion of such indirect determinations of jurisdiction have their profound historical and realistic reasons. The existence of such an indirect determinant makes the private international law more and more distant from the goal it is pursuing.
