新修改的刑事诉讼法正式确立附条件不起诉制度,迎合了深化司法体制改革的要求,为做好未成年人保护工作和办理未成年人刑事案件提供了法律规范,具有深远的意义和价值。检察机关作为附条件不起诉考验期内的监督考察主体,在相关司法解释及规则进一步细化之前应如何应对未成年人附条件不起诉工作,仍需摸索探讨。
The newly revised Criminal Procedural Law formally establishes the conditional non-prosecution system and meets the requirements of deepening the reform of the judicial system. It has far-reaching significance and value for the legal protection of minors and the handling of criminal cases involving minors. Procuratorial organs as the subject of supervision and inspection within the period of non-prosecution of conditional prosecution, how to deal with conditional non-prosecution of minors before relevant judicial interpretations and rules are further elaborated, it is still necessary to grope for exploration.
