同性恋一直是社会关注的一个焦点。随着同性恋解放运动兴起与发展,同性恋才得到社会的理解与包容。同性婚姻合法化一直是同性恋者们所关注的重点。现今世界上20多个国家和部分地区承认了同性婚姻的合法地位。同性婚姻在我国法律上是不被承认的,但在处理涉外同性婚姻的问题上,一概运用公共秩序保留则又略显不妥。如何正确运用公共秩序保留制度是处理涉外同性婚姻的效力问题的关键。
Homosexuality has always been a focus of the community. With the rise and development of the gay liberation movement, homosexuality has gained social understanding and tolerance. The legalization of same-sex marriage has been the focus of homosexuals. More than 20 countries and parts of the world today recognize the legal status of same-sex marriage. Same-sex marriage is not legally recognized in our country, but in dealing with the issue of same-sex marriage involving foreign people, the mere use of public order preservation is somewhat wrong. How to correctly use the system of keeping the public order is the key to the effectiveness of the same-sex marriage involving foreign people.
