改革事业单位管理体制是国家分类推进事业单位改革进程中重要的一环。在公益服务理念回归的当下,事业单位管理体制改革顺应社会契约变迁下社会管理模式的历史演化,有其历史必然性。同时,将渊源于社会契约,并在政府失灵中产生的软法应用到事业单位管理体制中,有着重要意义。而要切实有效地实现软法之治,离不开硬法的保障,因此,本文最终将在“刚柔”并济中探索事业单位管理体制的改革之路。
Reforming the management system of public institutions is an important part of the process of reforming public institutions in the national classification. At the moment when the concept of public service returns to the present, it is inevitable that the institutional management system reform will conform to the historical evolution of social management under the change of social contract. At the same time, it is of great significance to apply the soft law that comes from the social contract and the government failure to the institution management system. In order to effectively and effectively rule by soft law, we can not do without the guarantee of hard law. Therefore, this article will eventually explore the reform of institutional management system in “rigid and soft” economy.
