在国际承包工程市场上,一般称工程承包方提出的索赔为施工索赔,业主向工程承包方提出的索赔称为业主索赔. 施工索赔包括:因工程延迟提出的施工索赔;因施工中断和工效降低提出的索赔;因工程终止提出的索赔. 业主索赔包括:拖延竣工期限索赔;有缺陷工程计费;不正当地放弃工程或合理地终止工程的计费;其他业主索赔. 通过对引黄工程平万公路改线工程的施工索赔的分析,认识到:只有全面掌握索赔的起因、性质及其应该索赔的项目,才能在合法、合理的基础上做好反索赔工作,从而使工程施工阶段的投资得到有效控制.
