随着互联网的兴起,网民们可以快速的获得案件审理的相关情况,参与案件讨论,网络公开带来了民事诉讼审判公开的新高度。但是,当网民们用自己的价值观去指摘法院的判决时,汹涌的网络舆情又往往带给法院巨大的压力,迫使法院做出让步和改变,实际上制约了法院的司法独立。本文梳理了网络舆论与法院独立审判发生冲突的原因和表现,运用比较法的方法,借鉴域外经验,希望通过探索建立机制保障为实现网络舆论与公开审判的良性互动提供参考。
With the rise of the Internet, Internet users can quickly get the case hearing the case, participate in the case discussion, the Internet has brought open civil trial a new height. However, when netizens use their own values to refer to the court’s judgment, the surging public opinion of the network often brings tremendous pressure on the court, forcing the court to make concessions and changes, effectively restricting the judicial independence of the court. This paper sorts out the reasons and manifestations of clashes between cyberpublic opinion and the independent trial of the courts. By using the comparative law method and drawing lessons from extraterritorial experience, this article hopes to provide reference for realizing the benign interaction between cyberpublic opinion and open trial by exploring the mechanism of safeguarding.
