《中华人民共和国行政处罚法》经第八届全国人民代表大会第四次会议通过,自1996年10月1日起施行。这对卫生立法和监督执法工作提出了新的要求。因此,学习贯彻执行《行政处罚法》,依法正确地开展行政处罚工作,是摆在各级卫生执法人员面前的一项十分重要的任务。 在我国现行的卫生法规中都规定有行政处罚条款。行政处罚是一种严厉的行政行为,可以直接限制或剥夺违法行为人的人身权、财产权,因此对行政处罚要有较为严格的限制条件。由于以前对行政处罚的基本原则没有统一的法律规定,在实践中存在一些问题,如随意设定行政处罚,执法主体混乱,行政处罚程序缺乏统一明确规定,缺少必要的监督制约
The Administrative Punishment Law of the People’s Republic of China was approved by the Fourth Session of the Eighth National People’s Congress and came into force on October 1, 1996. This puts forward new requirements on health legislation and supervision and law enforcement. Therefore, studying and implementing the “Administrative Penalties Law” and properly carrying out the work of administrative punishment in accordance with the law is a very important task for health law enforcement personnel at all levels. In our current health laws and regulations are provided for the provisions of administrative penalties. Administrative punishment is a severe administrative act, which can directly limit or deprive the perpetrator of the personal rights and property rights of violators. Therefore, the administrative penalty should have more strict restrictions. Due to the fact that there are no uniform legal provisions on the basic principles of administrative punishment in the past, there are some problems in practice, such as arbitrarily setting administrative penalties, confusing law enforcement authorities, lack of unified and explicit provisions on administrative penalty procedures and lack of necessary supervision and restriction
