为应对全球化浪潮,各主要发达国家期望通过提高知识产权执法标准以巩固其在智慧型经济上的竞争优势地位。但由于世界各国对待知识产权保护的态度非完全一致,传统TRIPs协议平台已难以发挥效用。因而,发达国家选择探索新的路径,包括设立新的合作平台以及在小范围内签订新的国际协议,后期通过游说其他国家来推广这类协议。后者主要体现在ACTA协议以及TPP协议中。本文通过分析对比这三大协议在民事执法措施上的主要规定和特点,得出全球知识产权民事执法措施在总体上看正朝着高标准方向发展。
In response to the wave of globalization, major developed countries are looking to consolidate their competitive position in the smart economy by raising the bar for enforcement of intellectual property rights. However, as countries in the world do not completely agree on the protection of intellectual property rights, the traditional TRIPs agreement platform has become very difficult to be effective. Therefore, the developed countries have chosen to explore new routes, including setting up a new cooperation platform and signing new international agreements in small areas and later lobbying other countries to promote such agreements. The latter is mainly reflected in the ACTA protocol and the TPP protocol. By analyzing and comparing the main provisions and characteristics of the three major agreements in civil enforcement measures, this article concludes that the global enforcement measures of IPR are generally moving toward a high standard.
