为了不让《工资条例》(下称《条例》)成为“观赏性”立法,相关部委在草拟过程中加入了刚性规定。据悉,此次《条例》草案中对违反工资集体协商制度、不履行工资集体协商的企业,明确规定了应该承担的法律责任。一位参与《条例》起草的人士称,《条例》草案中规定了违规企业应该承担相应的法律责任,企业在规定限期内不进行改正的,处以5万元以上、20万元以下的罚款。
