第一章总则第一条为了加强卫生知识产权保与管理,维护国家、企事业单位、科技人员等产权所有或持有者的合法权益,鼓励发明创造,推动卫生科技进步和经济发展,依据国家有关法律、法规,制定本规定。第二条本规定适用于卫生系统的企业、事业单位、社会团体(以下简称单位)。第三条卫生部主管全国卫生系统知识产权保护与管理工作。省级卫生行政部门负责本地区卫生系统知识产权保护与管理工作。第四条本规定保护管理的知识产权,是指依照法律、法规规定或者合同约定,应该由单位所有或持有的知识产权,包括单位与他人共享的知识产权。

Provincial health administrative departments are responsible for the protection and management of intellectual property in the local health system. Article 4 The intellectual property rights for the protection and management under these Provisions refer to the intellectual property rights that should be owned or held by the entity, including the intellectual property rights shared by the entity with others, in accordance with laws, regulations or the contract.
