维持判决作为三大诉讼中行政诉讼的一种特有判决方式,其在特定的时期对我国行政诉讼法的适用起到了重要的作用。但随着行政法理论的深入和司法实践的发展,特别是驳回诉讼请求的确立以及更有效的运用使维持判决的继续存在与否发生了争议,本文正是基于此,着重分析了维持判决存在的种种不合理性,比照域外各国的经验,建议取消维持判决,以驳回诉讼请求判决取而代之。 As a unique way of judging administrative litigation in the three major lawsuits, the maintenance of verdict plays an important role in the application of our country’s administrative litigation law in a specific period.
