检察机关的非刑事职权是检察职权的组成部分,非刑事职权对于检察定位有着至为关键的作用,无论是定位于“法律监督”的我国检察机关还是定位于“法律守护人”或“政府律师”的域外检察制度,其对非刑事职权的规定都直接决定了检察定位的阐释。在西方主要法治国家检察机关或纯粹是作为政府律师的角色出现,或将检察机关偶尔当作咨议部门使用。我国检察机关非刑事职权是出于检察机关的理念定位而衍生出的非刑事职权,检察机关非刑事职权是证实检察机关法律监督职能最为重要的论据。
