乡镇政府对村民委员会的指导权是一个既包括行政指导又包含行政协助的复杂行为。对于法律规定的村民自治事项,乡镇政府原则上不能指导,只有在村民自治会危害国家法制统一、损害基层群众合法权益、不利于社会稳定以及村民与村民委员会之间发生纠纷等情形下方可予以指导。同时,乡镇政府对村民委员会应当进行科学指导,即指导既要符合科学的指导理念,又要具备科学的指导方法。
