陈顾远是中国20世纪著名的法史名家,其在法律史学理论领域创获颇多,为中国近代法律史学科体系的创建奠定了坚实的理论基础。他对法制与法制史的概念、法制史的研究对象以及法制史学科内涵等重大问题的科学阐发,为中国法律史学科体系的创建提供了有益启发;通过深入探讨,陈顾远最终把研究中国法制史所要解决的重大问题界定为“中国法制之史疑”、“中国法制之史实”、“中国法制发展之历史分期”三端,并就上述问题提出诸多创见,为中国法制史学者提供了智力支持,同时也为法律史学者指明了大致着力方向;陈氏还对“中国古代法律之变”、“中国古代法律之质”、“中国古代法律之量”等重大法制理论问题进行了理性思考,并对西方的新学理以及前代学者所倡导的“新史学”理论与方法进行继承与发展,为中国近代法律史学的发展做出了巨大贡献。
