本文在对“社区”、“社区矫正”等概念进行解析的基础上,首先对社区矫正的各种理论依据,包括国外“深化的复归理论”、“刑事补偿理论”、“行刑经济化”等刑罚理念以及我国的特殊理论基础进行论述,对社区矫正所体现的刑罚价值进行分析,认为在我国实行社区矫正具有政治、社会、法律、经济等多方面的现实意义。其次,回顾我国刑罚执行历史上与目前的社区矫正工作有关的经验,分析目前社区矫正试点的情况,认为目前的试点取得了显著成绩,主要是明确了社区矫正工作的主要任务、规定了社区服刑人员的范围、成立了专门负责社区矫正的机构、招收从事社区矫正工作的人员以及建章立制等。再次,文章认为由于社区矫正工作缺乏实践基础,尚处在探索阶段,在目前的试点中暴露出若干问题,主要体现在观念上未能适应刑罚方式的改革、法律上缺乏社区矫正的依据、具体操作上缺少社区矫正的制度与经验等。最后对如何跨越这些障碍提出建议,认为社区矫正工作的全面推广要求更新观念、健全法律、构建体制、完善制度。
