目前,我国公众参与食品安全风险规制在立法层面仍处于赋予公众单一建议权的权利配置状态,这既不能充分保证行政机关在食品安全风险规制的全过程广泛汲取民意,也很难保障食品安全风险规制的结果有效吸纳民意。鉴于此,文章首先分析了我国公众参与食品安全风险规制的现状;其次,论证了公众参与食品安全风险规制的合理性基础,就普通公众代表之间的共识会议制度作一探讨,以因应公众参与食品安全风险规制之不足;最后,文章从选定会议代表、获取信息和报酬、召开预备会议、正式召开会议等四个层面对该制度予以阐述。
